The plaintiff is a serious disabled adult who requires constant care and supervision, and receives services through the Medicaid waiver program to receive it. As a result of new service limitations that have been imposed on waiver recipients, the plaintiff’s services have been dramatically reduced. The lawsuit alleges that this violates the Americans with Disabilities Act (ADA), as well as state and federal Medicaid law. A motion for preliminary injunction has been filed. The case has been stayed pending a resolution to the Chickadaunce v. Minott case.
