This bill unfairly targets and criminalizes transgender Hoosiers by making it a misdemeanor for them to use the restroom consistent with their gender identity. The ACLU of Indiana strongly opposes this discriminatory and inhumane bill.
Restroom use is a fact of life. Transgender people have been using public restrooms that match their gender identity for decades, at work, in public spaces, and in schools. Courts have found a right to do so in numerous cases. This bill is not seeking to solve any real problem. Instead, it is seeking to make life harder for transgender Hoosiers and to put their safety at risk by requiring them to use a restroom that does not match their identity or appearance. Transgender people are part of our community, our families, our workplaces, and our neighborhoods and, just like everyone else, need to be able to safely access restrooms.
