The plaintiff is a seriously disabled adult who requires constant care and supervision, and receives services through the Medicaid waiver program. As a result of new service limitations that have been imposed on waiver recipients, the plaintiff’s services have been dramatically reduced. The ALCU of Indiana filed a lawsuit alleging this violates the Americans with Disabilities Act (ADA), as well as state and federal Medicaid law. The case has been stayed pending a resolution to the Chickadaunce v. Minott case.
